At Tomorro, we offer a legally binding electronic signature — meaning the electronic signature we provide has real legal value and is fully enforceable in a court of law, for example. Please read the additional information below to better understand the type of electronic signature we offer.


Legal value of our electronic signature

Offering an electronic signature with legal value means that we comply with the 4 legal requirements listed below:

  • The identity of the signatory is verifiable.

  • Once the signing process has begun, the document can no longer be modified. Otherwise, the signing process must be stopped and restarted later.

  • The document is considered signed only when all parties have signed.

  • The document cannot be modified after signing and is stored securely.


Tomorro's simple signature

Three types of electronic signatures exist, their main difference being their level of certification (simple, advanced, or qualified). Today, most of our current clients use a "simple signature" with an external electronic signature provider. That is why we decided to prioritise the development of this type of signature within Tomorro itself.

A simple electronic signature is suitable for the following types of contracts: NDAs, Master Sales Agreements, Data Processing Agreements, Partnership Agreements, Employment Contracts, Amendments...

By using our simple electronic signature, you will be able to download your signed PDF with a signature certificate, which includes the date of each signature, as well as the name and even the IP address of the parties who signed the document.

Note that in some cases, it may be useful to use an advanced or even qualified electronic signature. The main difference compared to a simple signature is that this type of signature requires double authentication to allow each signatory to sign the document. Advanced or qualified electronic signatures are used for real estate contracts, for example.


Are electronic signatures legally binding?

Tomorro's native signature is a simple electronic signature and is legally binding. The electronic signature has the same legal value as a handwritten signature, at two different levels:

At the European level

It complies with the regulations in force within the European Union, and more specifically with Regulation No. 910/2014 - eIDAS (Electronic Identification And trust Services), on electronic identification and trust services for electronic transactions within the internal market. This regulation defines and recognises three types of electronic signatures: simple, advanced, qualified.

Under French law

Articles 1366 and 1367 of the French Civil Code provide that the legal value of an electronic signature is the same as a handwritten signature.
